1. Introduction

Welcome to Arch Build App, operated by Arch Build Construction Consultants Ltd, a company registered in the Republic of Uganda ("we," "us," "our," or "Company").

This Privacy Policy describes how we collect, use, process, disclose, and protect the personal information of our users ("you" or "your") obtained through the Arch Build mobile application (the "App"), available on the Google Play Store, and our related online hardware marketplace services (collectively, the "Services").

By downloading, accessing, or using our App and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy. If you do not agree with our policies and practices, please do not use our Services.

2. Information We Collect

We collect information to provide, improve, and secure our Services, and to facilitate connections between manufacturers and clients.

A. Information You Provide Directly:

  1. Account Information: When you create an account as a Manufacturer or Client, we collect your name, company name, email address, phone number, physical address (including location in Uganda or elsewhere), business registration details, and a password.
  2. Profile Information: For Manufacturers, we collect product catalogues, specifications, certifications, and pricing information. For Clients, we may collect project details, purchase history, and inquiry data.
  3. Communication: Information you provide when you contact our customer support, participate in surveys, or communicate with other users through our platform.
  4. Financial Information: While we may not directly process payments, we facilitate transactions. Payment information (e.g., credit/debit card details, mobile money details) is collected and processed by our trusted third-party payment processors (e.g., banks, mobile money providers, PayPal). We do not store full card details on our servers. We may receive transaction IDs and confirmation details.

B. Information Collected Automatically:

  1. Device and Usage Information: We collect information about your device and how you use the App, including your IP address, device type, operating system, unique device identifiers, mobile network information, and App crash data. We also collect information about your interactions with the Services, such as the products you view, search queries, and time spent on features.
  2. Location Information: With your explicit permission, we may collect precise or approximate location data from your mobile device to help you find local manufacturers, suppliers, or project sites, and for delivery logistics.

C. Information from Third Parties:

  1. We may receive information about you from other sources, such as business partners (e.g., payment processors), marketing agencies, and publicly available sources, which we may combine with information we already have about you.

3. How We Use Your Information

We use the information we collect for the following business purposes, consistent with practices of global e-commerce platforms:

  1. To Provide and Maintain our Services: Create and manage your account, process transactions, connect you with manufacturers/clients, display product listings, and facilitate deliveries.
  2. To Improve and Personalize our Services: Analyze usage trends to improve the App's functionality, develop new features, and personalize your experience (e.g., showing relevant product recommendations).
  3. To Communicate with You: Send you service-related announcements (e.g., order updates, security alerts), respond to your inquiries, and send promotional communications (where you have consented, as required by law). You can opt-out of marketing communications at any time.
  4. For Security and Fraud Prevention: Protect our Services, users, and business from fraud, security threats, and other malicious activity. This includes monitoring for fraudulent transactions and unauthorized access.
  5. To Comply with Legal Obligations: Fulfill our legal, regulatory, and compliance requirements under Ugandan law and other applicable laws.

4. Legal Basis for Processing (GDPR & Int'l Considerations)

While our company is based in Uganda, we recognize global standards. Our processing of your personal information is based on the following grounds:

  1. Performance of a Contract: Processing necessary to fulfill our Terms of Service with you (e.g., processing your orders).
  2. Legitimate Interests: Processing necessary for our legitimate business interests (e.g., improving our Services, marketing, fraud prevention), where these interests are not overridden by your data protection rights.
  3. Consent: Where required by law (such as for certain marketing communications or precise location tracking), we will rely on your explicit consent. You may withdraw consent at any time.
  4. Legal Obligation: Processing necessary to comply with a legal obligation we are subject to in Uganda or other jurisdictions where we operate.

5. How We Share and Disclose Information

We may share your information in the following circumstances:

  1. With Other Users: To facilitate the marketplace, your business name, contact details (as per your profile settings), and product listings will be visible to other users.
  2. With Trusted Third-Party Service Providers: We engage vendors and partners who assist us with hosting, data analysis, payment processing, order fulfillment, delivery, marketing, customer service, and security. These parties are contractually bound to use your information only for the services they provide to us and in accordance with this policy.
  3. For Business Transfers: In the event of a merger, acquisition, financing, or sale of company assets, your information may be transferred to the new entity as part of the business assets.
  4. For Legal Reasons: We will disclose information if we believe it is necessary to comply with a legal obligation, protect our rights, property, or safety, or the rights, property, or safety of others, including to government authorities or law enforcement agencies in Uganda or elsewhere, as required by applicable law.
  5. With Your Consent: We may share information for any other purpose disclosed to you at the time we collect it, with your consent.

6. International Data Transfers

Your personal information may be processed and stored on servers located outside of Uganda, including in other countries, which may have data protection laws that are different from those in Uganda. For example, we may use cloud service providers with global infrastructure.

By using our Services, you consent to the transfer, storage, and processing of your information in such countries. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy, including relying on standard contractual clauses or other approved mechanisms for such transfers where appropriate.

7. Data Security

We implement appropriate technical and organizational measures, inspired by global best practices, to protect your personal information from unauthorized access, alteration, disclosure, or destruction. These measures include encryption (SSL/TLS), access controls, and secure server infrastructure. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee its absolute security.

Depending on your jurisdiction, you may have certain rights regarding your personal information. We will facilitate the exercise of your rights in accordance with applicable law. These may include:

We will notify you of any material changes by posting the new policy in the App and updating the "Last Updated" date. Your continued use of the Services after any change signifies your acceptance of the updated policy.

This Privacy Policy shall be governed by and construed in accordance with the laws of the Republic of Uganda. Any disputes arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of the courts of Uganda.
